2. Products
2.1 ‘Purple Pineapple Pot’ workshops. ‘Purple Pineapple Pot’ workshops are issued and can be redeemed for the specific experience associated with the particular ‘Purple Pineapple Pot’ workshops. ‘Purple Pineapple Pot’ workshops may be exchanged in accordance with the terms set forth below under “Return and Exchange policy”.
2.2 Gift Cards. ‘Purple Pineapple Pot’ Gift Cards can be redeemed for experiences only through ‘Purple Pineapple Pot’, and cannot be redeemed for services with any other merchant or service provider. ‘Purple Pineapple Pot’ Gift Cards cannot be redeemed or exchanged for cash.
3. Order
3.1 Validation of order. Validation of order is handled though third party service provider in Beirut under the name of “Ihjoz”. Before accepting your order, they will validate your order and credit card number you submitted. If the issuer of your credit card refuses to authorize payment to us (or our credit card service provider) we will not be liable for any delay or non-delivery.
3.2 Right not to process your order. We reserve the right not to process your order on the basis of unavailability
4. Refund and Exchanges
4.1 ‘Purple Pineapple Pot’ Courses. In case of course postponement or cancelation after your online confirmation, the amount paid will be transferred to your Purple Pineapple Pot account to take the same course at any other date offered, or another course at the same date. No cash will be returned to customer in case of postponement or cancellation, but only course credit. Credits could be transferred to other clients if an interest is exposed by writing only (e-mail to admin@purplepineapplepot.com).
4.2 Gift Cards. ‘Purple Pineapple Pot’ Gift Cards cannot be redeemed or exchanged for cash.
5. Services
5.1 Reservation. You need to make the reservation through ‘Purple Pineapple Pot’ website . Reservations are subject to availability of space and service on the specific date requested.
5.2 Requirements. Certain services or activities may be subject to certain conditions such as age limit, physical condition etc. You must consult the Service Provider’s terms and conditions to ensure that you meet their requirements.
5.3 Cancellation or modifications. If you decide to cancel or modify a reservation, you will be subject to the modification and cancellation policy including payment of cancellation fees.
6. General
6.1 All Service Providers of www.purplepineapplepot.com (the “Providers”) are independent and unaffiliated to ‘Purple Pineapple Pot’. ‘Purple Pineapple Pot’ is not responsible for any matters related to the Providers, including without limitation, the actions or omissions of any Providers. ‘Purple Pineapple Pot’ makes no warranties or representations OF ANY KIND, EITHER EXPRESS OR IMPLIED, regarding any ‘Purple Pineapple Pot’ Experiences or the Providers thereof, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY and FITNESS FOR A PARTICULAR PURPOSE. YOU ACKNOWLEDGE AND AGREE THAT ALL ‘PURPLE PINEAPPLE POT’ EXPERIENCES ARE SUBJECT TO THE TERMS AND CONDITIONS OF THE RELEVANT PROVIDER AND YOU SHALL LOOK SOLELY TO THE RELEVANT PROVIDER FOR ANY MATTERS OR COMPLAINTS RELATED TO THE EXPERIENCE.
‘Purple Pineapple Pot’ shall not be liable for punitive, special, consequential, incidental or indirect damages of any kind or nature, including without limitation, lost profits, regardless of whether such liability is asserted on the basis of contract, tort, strict liability or otherwise, which relate to or are otherwise connected to any ‘Purple Pineapple Pot’ Experience or the actions or omissions of any Provider in connection with the same, even if ‘Purple Pineapple Pot’ has been advised of the possibility of such damages.
By purchasing and/or redeeming an ‘Purple Pineapple Pot’ Experience or ‘Purple Pineapple Pot’ Gift Card, you hereby RELEASE AND FOREVER DISCHARGE and promise not to sue or assert against ‘PURPLE PINEAPPLE POT’ AND ITS SUBSIDIARIES, PARENTS AND AFFILIATES AND THEIR RESPECTIVE MEMBERS, MANAGERS, OFFICERS, AUTHORIZED REPRESENTATIVES AND AGENTS, EMPLOYEES FROM ANY AND ALL CLAIMS, causes of action, damages, losses, liabilities, EXPENSES AND COSTS whatsoever THAT YOU OR YOUR HEIRS, SUCCESSORS, EXECUTORS, ADMINISTRATORS OR OTHER PERSONAL OR LEGAL REPRESENTATIVES MAY HAVE, including WITHOUT LIMITATION, all claims at law or in equity of every nature and kind, known and unknown, suspected or unsuspected, presently existing or which may arise in the future caused by, arising from, related to or otherwise attributable to THE ACTIONS OR OMISSIONS ON THE PART OF ANY PROVIDER OR OTHERWISE ARISING IN CONNECTION WITH YOUR PURCHASE, REDEMPTION, BOOKING, CANCELLATION, EXCHANGE AND/OR PARTICIPATION IN ‘PURPLE PINEAPPLE POT’ EXPERIENCE.
SOME JURISDICTIONS MAY NOT ALLOW THE DISCLAIMER OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; THUS, SOME OF THE DISCLAIMERS OF WARRANTIES AND LIMITATIONS OF LIABILITY SET FORTH IN THESE TERMS AND CONDITIONS MAY NOT APPLY TO YOU.
You may be required to execute a separate waiver and release of liability in form and substance satisfactory to the Service Provider before being permitted to participate in the experience.
SERVICE PROVIDERS MAY OR MAY NOT BE COVERED BY LIABILITY AND/OR PROPERTY DAMAGE INSURANCE AND EVEN WHEN A SERVICE PROVIDER MAY HAVE OBTAINED SUCH INSURANCE, YOUR PARTICIPATION IN THE PROVIDER’S EXPERIENCE MAY NOT BE COVERED BY SUCH INSURANCE.
6.2 Indemnification. You agree to indemnify ‘Purple Pineapple Pot’, its officers, directors, and employees from any claim or demand and, including attorney’s fees, made by any third party, including the Service Provider, due to your actions or the use of Service.
7. Copyright terms and conditions
The copyright to all materials and content contained in www.Purple Pineapple Pot.com is owned or licensed by ‘Purple Pineapple Pot’ unless otherwise set forth and may not be used by you except as set forth in these Terms and Conditions.
